====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-07-2024 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 323, 504, 506, 392 of the Indian Penal Code and Section 27 of the Arms Act.
3. Prosecution case, in brief, is that informant obtained land in question by Israi Suit No. 3 of 2013 nearly five years ago but all the accused persons including this petitioner, variously armed, came on the land in question and forcibly cut two semal trees and 9 shisham trees causing loss of Rs. 2 lacs to the informant.
4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to the land dispute between the parties. After investigation police submitted
Patna High Court CR. MISC. No.37867 of 2024(3) dt.05-07-2024 2/2 final form against the petitioner. It is next submitted that there is no specific allegation of assault against the petitioner. Petitioner claims clean antecedent.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Bagha, West Champaran in connection with Chautarwa P. S. Case No. 294 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
