Patna High Court CR. WJC No.1291 of 2017 dt.14-11-2019 2/3 delay of approximately 7 days in reporting the matter of the missing person, namely Anshu Kumar, aged 8 years, who was residing at his 'Nanihal' in a village falling within the jurisdiction of Bettiah Town Police Station, but then, as revealing from the record, even the police was absolutely callous and negligent in investigating the matter pursuant to the registration of the F.I.R. bearing Bettiah Town P.S. Case No.534 of 2016 dated 7th of October, 2016 under Section 363 of I.P.C.

This Court issued several directions to the concerned Superintendent of Police to himself appear before the Court, as is evident from the orders dated 14th of March, 2018, 18th of May, 2018 and 18th of June, 2018. Today, the investigation is complete, but, unfortunately, the body of the child could not be found. According to the police, the child is traceless. We are of the considered view that at this stage no other and further orders are required to be passed and we close the matter with the hope and trust that even in future the police shall continue to trace the child. Also liberty is granted to the petitioner to challenge the investigation in an appropriate proceeding.
