Petitioner apprehends arrest in connection with Mahila P.S. Case No. 27 of 2018 registered for the offence punishable under sections 376, 506, 120B of the Indian Penal Code and section 4 of the Protection of Children from Sexual Offences Act.
Learned counsel appearing for the petitioner submits that petitioner has not committed any offence as alleged in the first information report. As a matter of fact, in order to create pressure upon the petitioner to marry with the informant, the present case with falsely and concocted story has been lodged. Petitioner has passed the matriculation examination in higher marks as would be evidence from Annexure-12 and at present
Patna High Court Cr.Misc. No.73922 of 2018(2) dt.18-12-2018 2/2 he is a student of Intermediate in B.S.S.M. Inter College, Deo, Aurangabad. Further, the father of the petitioner had also filed an application before the court of Sub Divisional Judicial Magistrate, Aurangabad stating therein that the family of the informant pressurized for marriage to petitioner and when he denied the present false case has been lodged, which would be evident from Annexure-3. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge, POCSO, Aurangabad in connection with Mahila P.S. Case No. 27 of 2018, G.R. No. 64 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
