JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2020 The office has pointed out several defects to which learned counsel of the petitioner assures that he shall remove the defects within four weeks from the date when Court starts physical function.

Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner is in jail custody since 31.7.2020 in connection with Ayar P.S. Case No. 77 of 2020 registered for the offences punishable under Sections 304/34 of the Indian Penal Code.

Petitioner happens to be son of the deceased and it appears that in course of quarrel with his father, petitioner gave

Considering the above stated facts as well as this aspect of the matter that the investigation against the petitioner has already been completed, let the petitioner, above named, be released on provisional bail till the removal of the defects on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge - cum - Special Judge, Excise Act, Bhojpur at Ara/concerned court in connection with Ayar P.S. Case No. 77 of 2020.

It is made clear that if the defects, as pointed out by the office, are removed within the above stated period, the provisional bail of the petitioner shall be deemed to be confirmed.
