The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 354, 354B, 354D, 509 of the Indian Penal Code and sections 8 and 12 of the POCSO Act.

As per allegation in the FIR, while victim girl was returning from her coaching class to her house, petitioner has intercepted her and started to teasing her. On Protest made by her, he has assaulted her by means of fist and slap causing injury over her left side eye and head.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner is co-villager of the informant. There is no allegation of physical

Patna High Court CR. MISC. No.33586 of 2023(2) dt.14-07-2023 2/2 misbehavior or immoral act against the petitioner. Injury received by the victim girl is simple in nature. Petitioner has got no criminal antecedent and languishing in judicial custody since 27.12.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 7th cum-Exclusive Special Court (POCSO Act), Patna in connection with Khajekalan P.S. Case No. 439 of 2022.
