JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-01-2021 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.

Prosecution's case in short is that the daughter of informant was married with Md.Injamul Haque @ Saddam four years ago. It is further alleged that only after six months, all the accused persons including the petitioners started torturing her for non-fulfilment of dowry demand. On 19.09.2019 he got information that his daughter was killed by all the accused persons. Thereafter he went to her matrimonial house and found some strangulation marks on

Learned counsel appearing for the petitioners submits that the petitioner no.1 is brother-in-law of the deceased whereas petitioner no.2 is cousin of husband of the deceased. They are living separately and have no concern with the affairs of deceased and her husband. Petitioners have got no criminal antecedent as stated in paragraph 3 of the bail petition. There is general and omnibus allegation against the petitioners and the husband of the deceased is already in custody. Considering the facts of the case, in the event of arrest/surrender within eight weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnia in K Nagar Police Station Case No. 363 of 2019, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
