2. Considering the allegation as alleged in the FIR and also taking into consideration the criminal antecedents of the petitioner, the Court is not inclined to release the petitioner on bail.

3. At this stage, the learned counsel appearing on behalf of the petitioner submits that from perusal of the allegation as alleged in the FIR, it would manifest that specific allegation of firing is against Dheeraj. It is next submitted that co-accused Abhishek Kumar had moved this Court seeking anticipatory bail by filing Cr. Misc. No.16435 of 2024 and the same was allowed by an order dated 14.03.2024 and thereafter Deepak Kumar was also granted the privilege of anticipatory bail by an order dated 28.03.2024 in Cr. Misc. No.17598 of

Patna High Court CR. MISC. No.35540 of 2024(2) dt.20-09-2024 2/2 2024.

4. On query of the Court that as to how many criminal antecedents, Abhishek had, the learned counsel fairly submits that Abhishek Kumar had antecedent of one case, but then is not aware of the criminal antecedents of Deepak.

5. The petitioner would be at liberty to renew his prayer for bail after framing of charge.
