This application for anticipatory bail arises out of Complaint Case No. 797C of 2018, disclosing offences under Sections 354, 380, 323, 453, 454 of the Indian Penal Code. The informant is wife of the elder brother of the petitioner, the petitioner and his brother live in the same house. It is alleged that when the petitioner's wife was trying to take away the informant's box from her room and when the informant objected she was abused and assaulted. It is evident from the first information report, that some petty dispute is the reason behind the occurrence alleged.

Be that as it may, a case for grant of anticipatory bail is made out. This application is allowed. Let the petitioner,

Patna High Court Cr.Misc. No.73252 of 2018(2) dt.21-12-2018 2/2 above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of Sri Manish Kumar Pandey, learned J.M. Ist Class, Jamui in Complaint Case No. 797C of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
