This is the second attempt of the petitioner for obtaining regular bail in connection with Sour Bazar P.S. Case No. 365 of 2021 registered under Sections 341, 323, 324, 307, 302, 379, 365(B), 448, 504 and 506/34 of the Indian Penal Code & Section 3⁄4 of Bihar Witch Craft (Prevention) Act, 1999. He is in custody since 24.08.2021. He has one criminal antecedent. Earlier learned counsel for the petitioner had withdrawn the bail application of the present petitioner with liberty to file a fresh application stating therein correct and complete criminal antecedents of the petitioner.

Learned APP for the State has opposed the prayer for bail of the petitioner.

Having regard to the seriousness of the allegations and the materials present in form of post-mortem report showing

Patna High Court CR. MISC. No.33282 of 2022(4) dt.18-01-2023 2/2 repeated blow given by the petitioner with deadly weapon upon the deceased, this Court is not inclined to enlarge the petitioner on bail.

The prayer for bail of the petitioner is, thus, refused. Let the trial be expedited.
