The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code.

As per the prosecution case, the five named accused persons are said to have assaulted the son of the informant leading to his death.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for oblique reasons. The manner of occurrence is other than what has been narrated in the F.I.R. The informant is not an eye witness to the occurrence. The allegations are general and omnibus in nature. The petitioner is in custody since 4.10.2021

Patna High Court CR. MISC. No.33650 of 2022(3) dt.16-01-2023 2/2 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the general and omnibus allegations in the F.I.R., the petitioner being in custody for more than a year since 4.10.2021, not having any criminal antecedent and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Sessions Case no. 12 of 2022 (arising out of Shahkund P.S. Case no. 255 of 2021) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-X, Bhagalpur.
