JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 This is an application for grant of anticipatory bail in connection with Gwalpara P.S. Case No. 92 of 2018, disclosing offences under Sections 406, 409, 420, 120(B) of the Indian Penal Code.

Allegation against two other accused persons is of defalcating crores of rupees and during investigation the name of the petitioner transpired that some amount of those two accused persons has also been found deposited in the account of the petitioner.

Submission of learned counsel for the petitioner is that the account of the petitioner is a salary account and there is no such deposit made by other co-accused persons. Further, the petitioner has no criminal antecedent.

Having heard both sides, considering the above facts and circumstances of the case, this application is disposed of with a direction to the petitioner to surrender within a period of six weeks from the date of receipt of the order and on surrender he will be released on bail to the satisfaction of court concerned till submission of charge-sheet and will cooperate in investigation with the police, otherwise his bail bonds shall be cancelled. However, once the charge-sheet is submitted, he has to surrender and pray for regular bail, which shall be considered on the basis of materials available on record. (Vinod Kumar Sinha, J) Amjad/- U T
