The petitioner apprehends his arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

Allegation is that all the FIR named accused persons including petitioner intercepted the informant and his companion Prince Kumar on the gun point and co-accused Mantu Yadav fired causing injury to Prince Kumar. Co-accused Sikandar Yadav fired upon the informant, but no firearm injury caused to him.

It is submitted that there is no allegation of any overt

Similarly situated co-accused have been granted bail by this Court vide order dated 07.03.2022 passed in Cr. Misc. No. 29635 of 2021. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Bhagalpur in connection with Bihpur (Bhawanipur) P.S.
