Learned counsel for the petitioner seeks permission to withdraw this application as against the petitioner nos.1 and 3 as they have been arrested by the police during the pendency of the bail application.

Permission is granted.

Accordingly, this application is dismissed as withdrawn as against the petitioner nos.1 and 3.

Now, this application is being heard only with regard to the petitioner nos.2 and 4.

The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 406, 420, 467, 468, 504, 506 and 34 of the Indian Penal Code.

As per the FIR, the petitioner no.1 and 2, on the pretext of helping the informant to apply for Vridha Pension, obtained her signature on a sale deed. On suspicion, the informant confronted the petitioners, then they abused her and threatened her of dire consequences.

It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. They have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. He submits that a title suit is pending before the Court of learned Sub-Judge First, Buxar and this statement is not denied by the learned counsel for the informant. Petitioners have no criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case as this is a case of civil nature of dispute, let the above named petitioner nos.2 and 4, be released on bail, in the event of their arrest or surrender before the learned Court below within a

No.36426 of 2024(2) dt.10-07-2024 3/3 period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Buxar Town P.S. Case No.13 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
