JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 307, 506/34 and other sections of Indian Penal Code.

As per prosecution case, this petitioner along other accused persons and 15-20 unknown persons surrounded the informant and then abused and assaulted him.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that specific accusation of assault is against one co-accused Nitish Kumar and so far this petitioner is concerned no specific overt act has been alleged

Patna High Court CR. MISC. No.33457 of 2022(2) dt.15-11-2022 2/2 against him. Moreover, it is submitted that petitioner is Preventive Officer at Custom House, Kolkata and on the date of occurrence of the alleged incident he was in Kolkata. Petitioner has got clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in Hisua P. S. Case No. 108 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
