JUSTICE JYOTI SARAN ORAL ORDER 04-02-2015 Heard Mr. Suresh Mukhiya, learned counsel appearing on behalf of the petitioner and learned counsel for the State.

The petitioner is in custody in connection with Deshari P.S. Case No.161 of 2013 for the offences punishable under sections 399 and 402 of the Indian Penal Code and the provisions of the Arms Act.

Learned counsel for the petitioner with reference to the FIR present at Annexure-1 submits that it is on the basis of the names disclosed by two persons who were arrested namely Guddu Kumar Rai and Suraj Sahani that the petitioner has been arrested even in absence of any recovery of arms from his possession. He further submits that both the arrested persons namely, Guddu Kumar Rai @ Guddu Kumar and Suraj Sahani

Patna High Court Cr.Misc. No.44399 of 2014 (2) dt.04-02-2015 have since been released on bail vide order passed in Cr. Misc. No.7297 of 2014 and Cr. Misc. No.34994 of 2014. Regard being had to the circumstances, let the petitioner namely, Rajesh Kumar Sah @ Rajesh Kumar be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Deshari P.S.
