28-08-2018 Heard learned counsel for the parties.
Sri Rahul Kumar, the District Magistrate-cumCollector, Begusarai is present in-person and has filed a show cause shown under his own signature.
Learned counsel representing the State points out the statements made in paragraph-5 of the show cause whereunder it is stated that Circle Officer, Begusarai has initiated a case bearing No.
2/2015-16 under the Encroachment Act, and in course of enquiry and measurement of the land in question, the people, who were staying there by way of encroachment, have been removed on 25.08.2018 in presence of local residents/public and government officials,
Patna High Court MJC No.2230 of 2015 (4) dt.28-08-2018 and SDO and CO, Begusarai both have directed the S.H.O. Muffasil to ensure that the land remains encroachment free in future. It is further stated in paragraph-6 of the show cause that some temporary structure/structures over the Bhind of the Pond of Mauza - Goshpur Thana No. 211, Khata No. 24, Khesra No. 83, 84, 85 and 86 having an area 4 Bighas 17 Kathas and 18 Dhoors has been finally and completely removed. The photographs of the encroached free land have been obtained and enclosed as Annexure-'C', 'C/1' & 'C/2' to the show cause.
Going through the statements made in the show cause, which have been taken note of hereinabove, this court is satisfied that this contempt proceeding should be dropped and is dropped and disposed of accordingly.
