JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-09-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Buxar Industrial P.S. Case No. 36 of 2019, registered for the offences punishable under Sections 341, 323, 467, 468, 471, 406, 420, 120B, 376, 511 and 34 of the Indian Penal Code.
Prosecution case is that informant has deposited Rs. 4,00,000/- in Divyang Jan Kalyan Seva Sansthan and when the informant went in the office of the aforesaid finance company and demanded back her money, petitioner along with other coaccused assaulted her and tried to outrage her modesty. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Petitioner is employee of the said company and he was not present at the time of occurrence. Patna High Court CR. MISC. No.30498 of 2019(3) dt.18-09-2019 2/2 Sayeed has been granted bail by a Coordinate Bench of this court vide order dated 23.05.2019 passed in Cr. Misc. No. 33798 of 2019. Petitioner has got no criminal antecedent and he is in custody since 28.03.2019.
Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar Industrial P.S. Case No. 36 of 2019.
