JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 09-12-2019 Petitioner has prayed for the following relief: " This application is being filed by way of Public Interest Litigation seeking direction upon the Respondents to ensure training, registration and functioning of Medical Laboratory Technicians through appropriate regulations, guidelines or regulatory bodies so that proper and appropriate services of this branch of medical health care and professional may reach to the people of Bihar. The mushroom growth of clinical establishments in Bihar is resulting to disharmony in services in the field of diagnosis through chemical and biological investigations in the absence of proper registration and control on medical laboratory technicians."

Patna High Court CWJC No.8055 of 2015(20) dt.09-12-2019 2/2 Mr. Y.C.Verma, learned senior counsel, appearing on behalf of the petitioner, states that he has already represented by filing representation dated 11.02.2015 to the Principal Secretary, Health Department, Government of Bihar, Patna but no decision has been taken till date.

Mr. Sanjay Kumar, the Principal Secretary, who is present in Court, states that if the petitioner represents afresh within a period of four weeks, any decision thereupon shall be taken in accordance with law within a period of three months thereafter. In view of the same, Mr. Y.C.Verma, learned senior counsel for the petitioner, contends that petitioner shall be content if writ petitioner is granted liberty to file a fresh representation before the Principal Secretary, Department of Health, Government of Bihar, Patna (Respondent no. 2) within a period of four weeks.
