Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-03-2021 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, huge quantity of foreign liquor was recovered from a closed room. It is alleged that the petitioner and other accused persons were engaged in the business of said illicit wine.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner.

Learned counsel for the State opposes the prayer for bail submitting that as per paragraph 3 of the bail petition,

Patna High Court CR. MISC. No.31515 of 2020(3) dt.04-03-2021 2/2 petitioner has got criminal antecedent and he is accused in three other cases of similar nature.

Considering the antecedent of the petitioner, his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
