JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2019 This application, for grant of anticipatory bail, arises out of Laheri P.S. Case No. 414/2018, disclosing offences under Sections 413, 414/34 of the Indian Penal Code. Prosecution case in short is that informant raided the house of the Sachidanand Prasad and recovered two stolen motorcycle and it is said that petitioner was residing in the said flat.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case only on the basis of suspicion and he has no concern with the recovered motorcycle.

Learned counsel for the State opposed the prayer for bail and submitted that petitioner is accused in three more cases, though he has mentioned about only one case in petition.

No.31705 of 2019(3) dt.08-08-2019 2/2 Having heard both sides, considering the facts and circumstances as well as the fact that petitioner is an accused in three more cases, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner, if so desire, may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.

This application is, accordingly, dismissed.
