The petitioners seek anticipatory bail in connection with Basopatti P.S.Case No. 144 of 2014,, registered for offences punishable under Sections 467, 468, 471 and 420 B, of the Indian Penal Code.

As per F.I.R., allegation against the petitioner is that she worked on the post of Auxiliary Nurse Midwifery (ANM) on the basis of forged documents.

Submission of the learned counsel for the petitioner is that she has not committed any crime and has falsely been implicated in this case and the petitioner joined in the year, 1991 and she continued on her post about ten years and when the petitioner was challenged this termination order, a Five Men Committee concluded that the certificate of the petitioner was

Patna High Court Cr.Misc. No.93 of 2019(3) dt.31-01-2019 2/2 forged, is not sustainable and ultimately quashed the order and later on the same termination order was challenged by LPA No. 230 of 2011, which was also quashed and the petitioner has no criminal antecedent.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each in connection with Basopatti P.S.Case No. 144 of 2014 ( G.R. No. 2429 of 2014), to the satisfaction of the learned Additional Chief Judicial Magistrate- V, Civil Court, Madhubani, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
