JUSTICE SHAILENDRA SINGH ORAL ORDER 14-08-2025 Heard Mr. Sharad Kumar Verma, learned counsel for the petitioner, Mr. Ajit Kumar, learned APP for the State and Mr. Anand Kishore Chaudhary, learned counsel for the informant.

2. Petitioner seeks regular bail in connection with Laukariya P.S. Case No. 109 of 2024 dated 24.10.2024 registered for the offences punishable under sections 96, 3(5) of the Bharatiya Nyaya Sanhita and later, sections 4 and 8 of the POCSO Act, were added.

3. The main submissions advanced by petitioner's counsel are that the petitioner is a 24 year old young person and the facts stated by the informant in the FIR, have not been supported by the victim in her statement recorded under section 183 of BNSS, which completely falsifies the prosecution's

Patna High Court CR. MISC. No.32502 of 2025(3) dt.14-08-2025 2/2 allegations and the petitioner has been languishing in jail since 03.03.2025 and against him, the investigation has been completed.

4. Learned counsel appearing for the informant submits that as per the information provided to him by the informant, a good relationship has been established between both the parties outside the court and they have settled the present matter.

Considering the aforesaid submissions and mainly taking into account the petitioner's custody period, victim's statement recorded under section 183 of the BNSS before the Judicial Magistrate and coupled with completion of investigation against the petitioner, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Laukariya P.S. Case No. 109 of 2024.
