Mr.Ram Bachan Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 24-10-2019 Heard learned counsel for the petitioner, learned counsel appearing on behalf of the State and learned counsel for Opposite Party No.2.

Petitioner apprehends his arrest in connection with Suapul Mahila P.S. Case No.37 of 2018, for the offence punishable under Sections 498A, 494, 323, 341, 504, 506 and 34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.

The dispute between the parties relates to the marital discord. It appears that the matter was referred for Mediation and the report of learned Mediator is on record. From perusal of the report of learned Mediator dated 21.10.2019, it appears that

Patna High Court CR. MISC. No.30783 of 2019(4) dt.24-10-2019 2/2 both the parties have settled their dispute amicably and a joint Memorandum of Agreement has been arrived at between the parties dated 21.10.2019 which is also on record. In view of the aforesaid, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner, above named, is directed to surrender before the learned Court below within a period of four weeks from today and in the event of surrender by him, he shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Supaul, subject to the condition that the petitioner will abide by the terms and conditions arrived at between the parties in Memorandum of Agreement dated 21.10.2019.

If the petitioner deviates from the terms and conditions of Memorandum of Agreement, the Opposite Party No.2 shall be at liberty to prefer an appropriate application before the appropriate Court of law.
