Petitioner seeks bail in Malsalami P.S. Case No.417 of 2019 registered under Sections 30(a) and 37(b)(c) of the Bihar Prohibition and Excise Act.

The informant alleged that he got information that the petitioner was illegally selling liquor near Bundel Toli and when a raid was conducted, the petitioner managed to flee away. One Pawan Kumar was apprehended and on search, 110 litres of country made liquor was found.

It is submitted that nothing has been recovered from possession of the petitioner. Pawan Kumar was apprehended. The apprehended person falsely implicated the petitioner in order to save himself. The petitioner is in jail since 13.06.2020. Taking into consideration the fact that the petitioner is

No.32330 of 2020(2) dt.07-12-2020 2/2 in jail since 13.06.2020 for recovery of 110 litres of country made liquor, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Malsalami P.S. Case No.417 of 2019 (Special Case No.9894 of 2019).
