This application for anticipatory bail, arises out of Narhat P.S. Case No. 199 of 2018, disclosing offences under Sections 419, 420, 467, 468, 471/307, 120(B) of the Indian Penal Code, 66 of I.T. Act, 2008, 18(B), 18(C), 27(B), 27(C), 28(A), 33 E.E.C. (B)/33(1) Drugs and Cosmetic Act and 3, 4, 5, 7, 9,(A) of the Drugs and Magic Remedies Act 1954. While attempting to parcel spurious medicines through post office, one Sanjay Kumar Gupta was arrested. In course of interrogation, he disclosed names of his associates. He also disclosed that he had contacted this petitioner for running the business of sell of spurious medicines. The petitioner is said
Patna High Court Cr.Misc. No.76856 of 2018(2) dt.16-01-2019 2/3 to have provided two rooms on rent to the main accused for running the aforesaid business. From the rooms also the Police have recovered the incriminating medicines.
Learned counsel, appearing on behalf of the petitioner, submits that the only allegation against the petitioner is that he had given two rooms on rent to the main accusedSanjay Kumar Gupta. He contends that there is absolutely no material to suggest that petitioner was found to be participating in this illegal sell of medicines. It has been argued that there is no chance of the petitioner fleeing from the course of investigation, if granting anticipatory bail to the petitioner, by this Court.
Considering the submission, as above, this application is allowed.
Let the petitioner, above-named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V, Nawadah in connection with Narhat P.S. Case No. 199 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

No.76856 of 2018(2) dt.16-01-2019 3/3 This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
