The petitioner has prayed for bail in a case registered for the offence punishable under sections 20(b)(ii)(B) of the NDPS Act.
Prosecution case relates to recovery of 6.250 kg of Ganja kept in three plastic bags tied with carrier of the bicycle of the petitioner and while the petitioner ws trying to escape, on chase he was apprehended by the police party and seizure list was prepared.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has got no criminal antecedent. He has no concern with the alleged recovery or nothing has been recovered from
Patna High Court CR. MISC. No.33760 of 2022(3) dt.13-02-2023 2/2 his conscious possession. The alleged quantity of recovery is not comes within the purview of commercial quantity. He is languishing in judicial custody since 14.01.2022. Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Madhepura in connection with Puraini P.S. Case No. 12 of 2022.
