This application for grant of regular bail arises out of Ahiyapur P.S. Case No. 422 of 2020, disclosing offences punishable under Sections 363,363A of the Indian Penal Code. The petitioner is in custody since 02.06.2020. According to the First Information Report, the informant's daughter was missing since 16.12.2019. She has alleged in the written statement, which is the basis for registration of the First Information Report that she received an information on 15.05.2020 from the petitioner that he had kidnapped the informant's daughter.
Learned counsel appearing on behalf of the petitioner
Patna High Court CR. MISC. No.33164 of 2020(5) dt.24-02-2021 2/2 has argued that delay of nearly five months in lodging of the First Information Report itself creates serious doubt on the veracity of the case of the prosecution. She further contends that there is no material to suggest petitioner's involvement in causing disappearance of the victim. The conduct of the informant of not informing the police and not disclosing the fact that her daughter was missing since December, 2019 indicates that the informant was knowing whereabouts the alleged victim. Case diary was called for, which is on record. On perusal of the case diary and considering the submissions made on behalf of the petitioner, in my opinion, a case for grant of regular bail is made out. This application is allowed.
Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Ahiyapur P.S. Case No. 422 of 2020.
