It is submitted by Counsel for the State that revised gratuity of the petitioner has already been paid. Relying upon the averments made in the counter affidavit, it is submitted that by communication dated 22.1.2016 (Annexure 'A') the claim of the petitioner for grant of benefits under ACP has been forwarded to the Director (Respondent No. 2). Since the claim has to be processed as per admissibility of the petitioner by Respondent No. 2 in light of the recommendation dated 22.1.2016, petitioner's Counsel submits that a direction be issued to expedite the process as the
Patna High Court CWJC No.5298 of 2015(3) dt.22-01-2019 2/2 issue has been lingering for quite sometime.
In view of the aforesaid submission Respondent No. 2 is directed to take a final decision in respect of the dues admissible to the petitioner under the heading ACP and MACP in light of the recommendation dated 22.1.2016 by Settlement Officer, Darbhanga within a period of three months from the date of receipt/production of a copy of this orde. The writ petition stands disposed of.
