The petitioner seeks bail in Thakurganj P.S. Case No. 59/2018, instituted for offences under Section(s) 308, 341, 323, 379, 447, 307, 504 and 34 of the Indian Penal Code. It is alleged in the written report that during Panchayati altercation had taken place between the informant and one Motibul Rahman. Thereafter Motibul Rahman along with 11 other F.I.R. named persons armed with weapons came at the house of informant and assaulted him. Petitioner is alleged to have assaulted the informant with iron rod causing head injury to him.

Injury report is available in case diary, from which it appears that informant has sustained one injury, i.e. lacerated

Learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case. Petitioner is in custody since 26.02.2019.

Keeping in view the period of custody spent by petitioner, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj, in connection with Thakurganj P.S. Case No. 59/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
