The petitioner seeks bail in Jalalpur P. S. Case No. 229 of 2018 instituted for the offence under Section(s) 365/34 of the Indian Penal Code.
In the written report, the informant has alleged that his villager Sita Ram Sah had kidnapped one girl of village Chainpur. The family members of the girl came to village on 18.11.2018 which include this petitioner and another accused persons as named in the written report and took away the handicapped son of informant, namely Raju Kumar Mahto with him to their house. It is further alleged that they took his son to Chapra station and when the informant informed to the Railway Police Station they made search but did not find son

It is further alleged that the informant met Hareram Sah and Shri Bhagwan Sah at the Station who informed him that his son had fled away and went to home. Case diary has been received wherein the statement of victim recorded U/s 164 Cr. P. C. is available. Learned APP after looking into the case diary submits that the victim girl in her statement U/s 164 Cr.P.C. has levelled general and omnibus allegation against this petitioner. Petitioner is in custody since 21.2.2019.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM IX, Saran at Chapra in connection with Jalalpur P. S. Case No. 229 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
