2. The petitioner is apprehending arrest in connection with Birpur P.S. Case No. 55 of 2024 lodged on 20.02.2024, for the offence punishable under Sections 366, 366(A) & 34 of the Indian Penal Code.

3. As per the prosecution, FIR has been lodged against five named accused persons including the present petitioner against whom there is an allegation that they have kidnapped the informant's daughter with intention to do wrongful acts with her.

4. Learned counsel for the petitioner submits that the

Counsel submits that on previous occasion, case diary along with statement of victim under Section 164 of the Cr.P.C has been called for. Counsel submits that the alleged victim girl has been recovered and she has narrated her statement under section 164 of the Cr.P.C in which the victim has not supported the prosecution version. Counsel submits that the victim herself went with the petitioner and subsequently, they entered into marriage and living as husband and wife. Counsel further submits that the petitioner has no criminal antecedent.

5. Learned APP for the State opposes the prayer for bail of the petitioner but submits that from perusal of statement under section 164 of the Cr.P.C, it transpires that the victim has categorically stated that she herself went with the petitioner and nobody has put pressure on her.

6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of Additional Chief Judicial Magistrate, Birpur at
