The petitioner being the husband of the daughter of the informant is languishing in custody since 05.05.2014 in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 498A/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.

The accusation is of assaulting the daughter of the informant and administering poison. Though, the petitioner also killed his first wife by administering poison. It is submitted by learned counsel for the petitioner that injury report is not on the record. This fact has not been controverted by the

Patna High Court Cr.Misc. No.41314 of 2014 (04) dt.10-02-2015 2/2 learned counsel for the State after going through the case diary. Considering the period under custody and the fact that injury report is not on the record, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Purnea in connection with Dhamdaha P.S.
