JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 The petitioners apprehend their arrest in connection with Excise Special Case No. 7055 of 2018 arising out of Malsalami P.S.Case No. 274 of 2018 registered under Sections 30(a) of the Bihar Excise and Prohibition Act, 2016.

Allegation is of recovery of 4 and odd litres of liquor from the co-accused and he has named these petitioners. Submission of learned counsel for the petitioners is that recovery is not made from the possession of the petitioners and they have no criminal antecedents.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within

Patna High Court Cr.Misc. No.47 of 2019(3) dt.23-01-2019 2/2 a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Excise Special Case No. 7055 of 2018 arising out of Malsalami P.S.Case No. 274 of 2018 ; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
