21-12-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is seeking anticipatory bail in connection with Nautan P.S. Case No. 204/16 (G.R. No. 2983/16) registered under Sections 406/409/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is a retired employee. He has superannuated from service from the post of Panchatyat Secretary and while retiring from service he had given the charge and handed over all official records to the concerned authorities and there was no allegation against him that he had kept any records. It is submitted that at this stage there was no reason for lodging the First Information Report if the records relating to the certificates of the appointed teachers were not available in the office of the Block Development Officer. It is submitted that petitioner has no criminal antecedent.

No.76143 of 2018(2) dt.21-12-2018 2/2 In the given facts and circumstances of the case where it is stated that the petitioner has retired employee and earlier there was no allegation against him for keeping any official records, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - Vth, Bettiah, West Champaran, in connection with Nautan P.S. Case No. 204/2016 (G.R. No. 2983/16), subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of three weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of bail. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
