Petitioner is seeking anticipatory bail in connection with Bariyarpur P.S. Case No.118 of 2018 dated 18.08.2018 registered for the offences punishable under Sections 25 (1-A), 25(1-AA), 25(AC), 25(1-b)A, 26 (i) (ii) and 35 of the Arms Act. Learned Senior Counsel representing the petitioner submits that the name of the petitioner has been presented in the present case merely on the basis of a false statement made by the co-accused. There is no recovery of any arms or ammunition from the possession of the petitioner.
Learned APP for the State is present and has opposed the prayer for bail.
In the given facts and circumstances, where it is the

No.75210 of 2018(2) dt.21-12-2018 2/2 submission of the learned Senior Counsel for the petitioner that nothing has been recovered from the possession of the petitioner, let the petitioner abovenamed be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. II, Munger in connection with Bariyarpur P.S. Case No.118 of 2018 dated 18.08.2018 subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of three weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of his bail bond. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C. (Rajeev Ranjan Prasad, J) r.r.ojha/- U T
