JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2019 By way of the present restoration application, petitioner seeks to restore the Cr. Miscellaneous No. 4419 of 2019, which stood dismissed for non prosecution vide order dated 26.04.2019.

Submission of learned counsel for the petitioner is that due to eye infection, learned counsel could not appear in the court court on the date, when the case was listed and as such the case was dismissed for want of prosecution.

Having considered the averments made in restoration application as well as the submission of learned counsel for the petitioner, Cr. Miscellaneous No. 4419 of 2019 is restored to its
