2. The petitioner makes a prayer for bail in connection with Patkhauli P.S Case No.159 of 2024 registered for offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, the recovery is of total 66.4 litres of foreign liquor made from a pick-up van.

4. Learned counsel for the petitioner submits that the name of the petitioner has surfaced in the present case on a disclosure made by a local chaukidaar. No recovery has been made from the physical and conscious possession of the petitioner and it has also been submitted by the learned counsel for the petitioner that the owner of the pick-up van has already

Patna High Court CR. MISC. No.32535 of 2025(2) dt.16-05-2025 2/2 been granted the privilege of anticipatory bail vide order dated 02.05.2025 passed in Cr. Misc. No.30131 of 2025. The petitioner is in custody since 07.01.2025.

5. Learned APP opposes the bail on account of the fact that the petitioner has three criminal antecedent of similar nature. However, it is submitted that the petitioner is on bail in all the said cases.

6. Considering the period of custody and that charges have already been framed, the petitioner is enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Sri Pramod Kumar, Special Judge, Excise, Bagaha, West Champaran, in connection with Patkhauli P.S Case No.159 of 2024, subject to the condition that the petitioner shall co-operate in the investigation/trial.
