JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Dumariyaghat P. S. case no. 120/2017 registered under sections 272, 273 of the IPC and section 30(a) of the Bihar Prohibition Act.

In huge quantity Indian made foreign liquor were recovered from a vehicle. Petitioner happens to be owner of the aforesaid vehicle. However, submission on behalf of the petitioner is that the vehicle was being driven by its driver at the relevant time of alleged recovery and the petitioner was not aware as to what was being carried by her driver in her vehicle.

Patna High Court Cr.Misc. No.76430 of 2018(2) dt.20-12-2018 2/2 Moreover, driver of the aforesaid vehicle was caught on the spot but he did not disclose that it was the petitioner who kept seized liquor in the said vehicle.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the fact that the petitioner does not have any criminal antecedent, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the 4th Addl. Sessions Judge-cum- Special Judge, Excise, East Champaran, Motihari in Dumariyaghat P. S. case no. 120/2017 subject to condition as laid down under section 438(2) of the Cr.P.C.
