The petitioner is seeking anticipatory bail in connection with Dighwara P.S. Case No. 186/2018 registered under Sections 341, 323, 324, 379, 504, 427/34 of the Indian Penal Code. As per First Information Report, this petitioner along with three others starts demolishing the Bathan of the informant and when informant objected, the accused persons pushed him down on the earth. Petitioner also snatched golden chain and Mangalsutra from the wife of the informant and threatened him to kill. Learned counsel for the petitioner submits that the informant and the petitioner are co-sharers and they are having land dispute because of which the petitioner has been falsely implicated in this case. In this connection, attention of this court has been drawn towards the statement made in paragraph 12 of the petition. Learned
Patna High Court Cr.Misc. No.74787 of 2018(2) dt.20-12-2018 2/2 counsel further submits that the petitioner was earlier involved in one case in which he is on bail.
Learned counsel for the State is present and opposes the prayer for anticipatory bail of the petitioner. In the given facts and circumstances of the case, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with Dighwara P.S. Case No. 186/2018, subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer will be at liberty to take steps for cancellation of bail. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
