The petitioner is apprehending his arrest in connection with Paliganj P.S.Case No.96 of 2019 registered for the offences punishable under Sections 498A, 304(B) and 201/34 of the Indian Penal Code.

From perusal of the FIR, it appears that the informant's daughter, namely, Rinki Kumari was killed by the petitioner and his family members due to non-fulfilment of demand of dowry and her dead body was secretly disposed of. It is submitted on behalf of the petitioner that the petitioner is elder brother-in-law (Bhaisur) of the deceased. It is further submitted that the petitioner is separate in mess and

Patna High Court CR. MISC. No.34018 of 2019(3) dt.11-09-2019 2/2 business and having no concern with the affairs of the deceased. Petitioner having got clean antecedent. It is further submitted that the deceased died due to illness which is evident from perusal of the FIR.

Considering the facts aforesaid, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Danapur/successor Court in connection with Paliganj P.S.Case No.96 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
