The petitioner seeks bail in connection with S.T. No. 159 of 2025, arising out of Sahebganj P.S. Case No. 469 of 2024 instituted for the offence under Sections 103(1) & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

On 13.09.2024 at about 10:30 PM, one Ashish Kumar alias Bittu left with Ramu Sah. Shortly after, the informant and others found him being assaulted with knives by Karan Kumar (petitioner) along with Ramu Sah, Ravi Sah alias Laddu, and others. Petitioner was seen holding a blood-stained knife while fleeing. Ashish was taken to Sahibganj Hospital, where he was declared dead.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16-09-2024. Petitioner bears no criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. It is submitted that there is delay of two days in lodging the FIR. There is no specific allegation against the petitioner, rather allegation is against all co-accused persons. Other coaccused person has been enlarged on bail by this Court vide order dated 30-04-2025, passed in Cr. Misc. No. 5363 of 2025. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. It is submitted that postmortem report corroborates the allegation levelled in the FIR as the cause of death is found injuries caused by sharp pointed weapon. Several eye witnesses have supported the prosecution case, which fact finds mention at paragraph Nos. 12, 13 & 44 of the case diary.

Considering the aforesaid facts and circumstances of the case, there being direct allegation of assaulting the deceased by means of knife against the petitioner, which is fact is corroborated by several eye witnesses and postmortem report,

Patna High Court CR. MISC. No.32986 of 2025(3) dt.11-07-2025 3/3 hence, this Court is not inclined to grant bail to the petitioner. Prayer for grant of bail is, accordingly, rejected. 8.

The Trial Court is directed to expedite the trial as expeditiously as possible without any undue delay and unnecessary adjournments.
