2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 309(4) and 351(2) of the BNS.

3. The case of the prosecution is that the informant is a shopkeeper and he deals in hardware. On 19.09.2024 at about 3:00 PM, he was at his shop. At that time three persons arrived on Apache motorcycle. They were armed with weapon. They looted Rs.31,000/- from the informant on gun point.

4. Learned counsel for the petitioner submits that the FIR was lodged against unknown miscreants. During course of investigation one Pawan Kumar has named in his confessional

Learned counsel for the petitioner has submitted that nothing has been recovered from the possession of this petitioner. It has also been submitted that similarly situated co-accused Vishal Kumar has been granted bail by this Court vide Cr. Misc. Case No. 30433 of 2025. The case of this petitioner stands on similar footing. The petitioner is in custody since 10.12.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chhauradano P.S. Case No. 228 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Raxaul at Motihari, East Champaran.
