JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 27-09-2019 Heard learned counsel for the petitioner, learned APP for State as well as learned counsel representing the O.P.No.2. The petitioner in this case is seeking anticipatory bail in connection with Complaint Case No.90(c)/2017 registered for the offences punishable under Sections 341, 504, 406 and 323 of the Indian Penal Code.
Pursuant to the order dated 13.08.2019, petitioner has submitted a demand draft of Rs.50,000/- in the name of the complainant-opposite party no.2 in the court below. The complainant may receive the same from the court below. So far as rest of the amount i.e. 1,40,000/- is concerned, learned counsel for the parties agree that the said
Patna High Court CR. MISC. No.33918 of 2019(4) dt.27-09-2019 2/3 amount may be allowed to be paid in four installments of Rs.35,000/- each every month beginning from 15th October, 2019. On receipt of the entire payment of Rs.1,90,000/- the complainant-opposite party no.2 shall take steps to close the case in the court below.
Considering the facts and circumstances of the case, let the petitioner above named in the event of his arrest or surrender within a period of four weeks from today, be enlarged on bail on furnishing of bail bonds of Rs. 15,000/- (fifteen thousand ) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VIth, Danapur, Patna in connection with Complaint Case No.90(c)/2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. i.e. (i) a condition that the person shall make himself available for interrogation by a police officer as and when required;
(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
(iii) a condition that the person shall not leave India
