This application for regular bail arises out of Chand P.S. Case No. 101 of 2019, disclosing offence punishable under Sections 302/34 of the Indian Penal Code.

Petitioner is the husband of the deceased. The deceased was married to the petitioner in the year 2009. There is allegation in the FIR of demand of dowry.

Though there is allegation that the deceased was done to death by the petitioner and the family members, there is no eye-witness to such occurrence, learned counsel appearing on behalf of the petitioner contends. He has further submitted that after appreciating true state-of-affairs, the informant has resiled from the accusation made in the FIR. The petitioner is in

Patna High Court CR. MISC. No.32262 of 2020(4) dt.11-01-2021 2/2 custody since 23.10.2019. It has been submitted that if the petitioner is granted regular bail, there is no chance of the petitioner fleeing away from the course of trial. Considering the above, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned ACJM-IVth, Kaimur at Bhabua, in Chand P.S.
