2. The petitioner seeks bail in a case registered for the offence punishable under Sections 103(1) and 3(5) of the B.N.S..

3. As per prosecution case, informant alleged that on account of pre-existing enmity, all the F.I.R. named accused persons, including this petitioner, killed her mother-in-law.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. From bare perusal of the F.I.R. it is apparent that informant is not an eye witness to the occurrence. At best, this petitioner, along with other accused persons, was only seen fleeing from the

Patna High Court CR. MISC. No.32573 of 2026(2) dt.15-05-2026 2/2 place of occurrence. There is no specific accusation of overt act against this petitioner. During investigation, no one claimed to have seen the alleged occurrence. Petitioner claims clean antecedent and is in custody since 17.02.2026 . Moreover, charge-sheet has already been submitted.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, clean antecedents and period of custody, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Motihari, East Champaran in connection with Bhopatpur P.S. Case No. 88 of 2025.
