JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-05-2019 This application has been filed for transfer of Criminal Misc (Maintenance) No.52 of 2018 filed by the opposite party no.2 under Section 125 of Cr.P.C. from the Court of learned Principal Judge, Family Court, Aurangabad to the Court of learned Principal Judge, Family Court, Patna. The ground for transfer is that the petitioner is working at Ankaleshwar, District Bharuch (Gujrat) and as such he has difficulty in attending the Family Court day to day basis. However, after some arguments, learned counsel for the petitioner seeks permission to withdraw the application in order to file such an application before the Family Court, Aurangabad for dispensation of his presence on each and every day.
