Considering the stand taken in the counter affidavit no indulgence can be granted in the present proceeding as the respondents have not concluded the Jamabandi Cancellation Proceeding and so long as the Jamabandi proceeding has not come to an end, it cannot be conclusively held out that the land in question is public land.

Since the matter is pending consideration for the last several years, it would be appropriate that the concerned

Patna High Court CWJC No.9703 of 2015(4) dt.22-04-2019 2/2 authorities of the Revenue Department shall take final decision with regard to the pending Jamabandi cancellation proceeding and take the issue to its logical end within a period of four months from the date of receipt/production of a copy of this order and thereafter take steps for removal of encroachment. With the aforesaid, the writ application stands disposed of.
