JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-12-2020 In view of the submission and undertaking of the learned counsel for the petitioner, at the time of hearing of this application, through Video Conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 04.12.2020, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.

Heard learned counsel for the petitioner and the learned A.P.P. for the State, through Video Conferencing. The petitioner seeks bail in connection with POCSO 28 of 2020, arising out of Sasaram (Town) P.S. Case No.167 of 2020, registered under Sections 290/34 of the Indian Penal Code, Sections 3(1), 3(2), 4, 5, 6 and 7 of the Immoral Traffic (Prevention) Act, 1956 and, later on, added Sections 4/16 of the POCSO Act. On secret information, raid was conducted on 02.03.2020

Patna High Court CR. MISC. No.33036 of 2020(2) dt.15-12-2020 2/2 at 03.30 P.M. at Hotel Kaimur Dhaba, where six boys and six girls were found in objectionable condition. The petitioner was one of them.

Learned counsel appearing on behalf of the petitioner submits that the petitioner, who is student, has falsely been implicated in this case on mere suspicion as the petitioner, at that time, had gone to take the meal at the said Dhaba. The petitioner has no criminal antecedent and is in custody since 03.03.2020. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Rohtas at Sasaram, in connection with POCSO 28 of 2020, arising out of Sasaram (T) P.S. Case No.167 of 2020.
