The petitioner seeks bail in connection with Beldour P.S. Case No. 82 of 2019 instituted for the offence under Sections 448, 323, 324, 379, 307/34 of the Indian Penal Code.

Prosecution case as emanated from the FIR is that co-accused including the petitioner uprooted the maize crops of the informant whereafter they were forcefully selling the soil. On objection being raised by informant's father, all the accused persons assaulted the family of the informant. It is next alleged that all the accused persons stolen Rs. 25,000/- cash and golden chain.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 07-12-2023. Petitioner bears one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is no specific allegation levelled against the petitioner. There is general and omnibus allegation against the petitioner. Co-accused, namely, Santosh Kumar, has been granted bail by the Court below itself. It is next submitted that there is subsisting land dispute between the parites. It is lastly submitted that police after investigation has submitted charge sheet in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of
