JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-12-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 377 and some other allied Sections of the Indian Penal Code, u/s 75 of Juvenile Justice Act and u/s 3(2)(v) 3(2)(va) of the SC/ST (POA) Act. As per the prosecution case, co-accused Jagat Patel committed unnatural offence with son of informant. Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation. There is no specific allegation against this petitioner of committing unnatural offence. Petitioner claims clean antecedent and is in custody since 27.01.2021 and investigation in this case is complete.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VII-cum- Special Judge, POCSO Act, West Champaran, Bettiah in connection with Inerwa PS case No. 10/2020.
